This Terms and Conditions document governs the use of magwarehouse.com (including magwarehouse.co.nz) Online Service (the Service) including shopping and participation in promotions run by Eastern Rims Ltd.
Shopping Terms & Conditions
Purchasing from magwarehouse.com
magwarehouse.com shopping gives customers convenient, quick, easy and secure shopping. Upon receipt of your order an email confirming the order will be sent to you. The order will then be processed and shipped to you within two working days. Any delay in the process of your order will be notified to you immediately by e-mail.
Products displayed on the site can be purchased using secure online credit card facility or at our retail outlet at 519 Ellerslie Panmure H'way Auckland, NZ.
Pricing
All prices in the shopping areas are in New Zealand dollars (NZ$) including GST (12.5% sales tax). All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.
International duties and taxes
The customer is responsible for any duties and taxes relating to the purchase of products from magwarehouse.com that may apply in his or her respective country.
Guarantees
All purchases made from magwarehouse.com through this site are protected under New Zealand law through the Consumer Guarantees Act 1993 and the Fair Trading Act 1993. Any products purchased through this site for personal use may be returned to magwarehouse.com if they are considered faulty. The product will then be replaced. Only failing this will the purchase price be refunded. This will happen in a reasonable amount of time as defined in the Consumer Guarantees Act 1993.
Except as provided in the Customer Guarantees Act 1993, all warranties, descriptions product representatives or advice given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample merchantability or otherwise are expressly excluded.
The customer will ensure that any products purchased are used for purposes for which they are suitable and shall be responsible for ensuring all necessary skill and care in maintaining and using the product purchased.
Returns
A customer is entitled to return goods if there is a defect in the goods of a substantial nature. A "defect" is any aspect of an item or service that is not of acceptable quality. The New Zealand Consumer Guarantees Act requires customers to reject the goods within a "reasonable time" from purchase.
Please be aware that it is magwarehouse.com policy to pass on any customs duty that is applied to an item that has been returned for repair or replacement by an overseas customer.
magwarehouse.com will not accept the return if:
a) The suggested fault is found to be caused by the customer and is not covered by provisions of the NZ Consumer Guarantees Act, or
b) The reason given for replacement or rejection is in fact not able to be validated and cannot be aligned to qualifying circumstances as defined by the NZ Consumer Guarantees Act.
Refunds
Consideration for refund will be given on the basis that the goods are defective in some way, as per provisions of the New Zealand Consumer Guarantees Act. Any refund will be given at the sole discretion of magwarehouse.com. All refunds to overseas customers will be subjected to the deduction of any customs duty charge that was applied to the returned item(s).
Delivery
Irrespective of whether an ordered item is being sent to a destination within New Zealand or to an overseas country, magwarehouse.com ceases to be liable for the loss/ theft or misplacement of the item(s) as soon as goods are picked-up by the transporting courier company, providing that the correct consignee details are recorded on the courier packaging.
The courier company is liable where the loss/ theft or misplacement of the goods is due to some proven fault of their own. Please be aware that the courier company used, does not require specifically "your" signature to recognise that the goods have been delivered as per delivery instructions provided - they need only obtain the signature of someone who is available at the stipulated delivery address. We advise that you inform a trusted person to sign for your consignment in the event that you perceive you will be unable to be present at the delivery address at the time your goods are destined to arrive.
As soon as your payment has been processed, and your ordered product is packaged ready for despatch, we will e-mail you your despatch confirmation, which will display the courier consignment note details that your goods will travel against. Please use these details to commence any consignment tracking activities required. If you would like assistance to track your goods, please just contact us. We will be happy to help.
Please Note -
As soon as a signature is written onto the courier's consignment note to indicate that the goods have been received, liability for the loss, theft or misplacement of the goods becomes that of the person who ordered/ received the goods.
If you need to return an item, you must make your own appropriate courier (and insurance) arrangements. The liability for loss, theft or misplacement of the item(s) that you are returning, will transfer from you to the chosen courier company immediately upon pick-up of the goods (according to the policy of that courier company), and will transfer from the courier company to magwarehouse.com upon a signature being applied to the accompanying consignment note in that store.
If your goods are being returned under a claim for repair or replacement, and accepted by magwarehouse.com to be in accordance with the provisions of the NZ Consumer's Guarantees Act, the cost you incurred freighting the item(s) back to the issuing store will be credited to you.
